# Terms of Service

> Terms and conditions for using Vectorized (AI Vectorizer) - Image Tracer. Last updated January 2025.

## Introduction

Welcome to Vectorized (AI Vectorizer) - Image Tracer (the "Service", "Plugin", "we", "us", or "our").

By installing, accessing, or using our Figma plugin, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

  **TL;DR**: Use the plugin responsibly. Credits are non-refundable and expire in 6 months. You own your output SVGs. We may change pricing with notice. We're not liable for business losses.

## 1. Service Description

### 1.1 What We Provide

**Vectorized (AI Vectorizer) - Image Tracer** is a Figma plugin that provides:

* **AI Vectorization**: Convert bitmap images (PNG, JPG) to scalable SVG using Vectorizer.ai API
* **Smart Presets**: Pre-configured settings for logos, illustrations, line art, and high-fidelity conversion
* **HD Preview**: 2-credit preview before committing to full conversion
* **Custom Controls**: Adjust quality, detail, colors, and other parameters
* **Credit System**: Pay-as-you-go pricing with no subscriptions

### 1.2 How It Works

1. You select a bitmap image in your Figma file
2. You choose settings or a preset
3. You purchase credits to convert the image
4. We send your image to Vectorizer.ai API for processing
5. We return the SVG to your Figma canvas
6. Your image is deleted from our servers within 60 seconds

  **Third-Party Dependency**: Our service relies on Vectorizer.ai's API. Service interruptions may occur if Vectorizer.ai experiences downtime.

### 1.3 Service Availability

* **Uptime Target**: 99% uptime (excluding scheduled maintenance)
* **Maintenance**: Scheduled during off-peak hours with advance notice
* **No Guarantee**: We do not guarantee uninterrupted service
* **Third-Party Risks**: Vectorizer.ai outages may affect service

## 2. Account and Registration

### 2.1 Figma Account Required

To use the Service, you must:

* Have a valid Figma account (Free, Professional, or Organization)
* Be at least 13 years old (or 16 in the European Union)
* Provide accurate information to Figma
* Maintain the security of your Figma account

**We do not create accounts**. Your Figma User ID is automatically used to identify you.

### 2.2 Account Responsibilities

You are responsible for:

* All activity that occurs under your Figma account
* Keeping your Figma login credentials secure
* Notifying us immediately of any unauthorized use
* Complying with Figma's Terms of Service

**We are NOT responsible** for losses due to compromised Figma accounts.

## 3. Acceptable Use

### 3.1 Permitted Uses

You may use the Service to:

* ✅ Vectorize images for personal or commercial projects
* ✅ Convert logos, illustrations, icons, and photos
* ✅ Use output SVGs in client work (you retain ownership)
* ✅ Process copyrighted images you own or have permission to use

### 3.2 Prohibited Uses

You may NOT:

* ❌ **Abuse the Service**: Automated scraping, bot usage, reverse engineering
* ❌ **Violate Laws**: Process illegal content (counterfeit logos, pirated artwork)
* ❌ **Infringe Copyright**: Vectorize images you don't own without permission
* ❌ **Resell Access**: Sell, rent, or sublicense your credits to others
* ❌ **Create Competing Services**: Use our API or service to build a rival product
* ❌ **Overload Systems**: Excessive API calls, denial-of-service attacks
* ❌ **Circumvent Limits**: Exploit bugs to gain free credits

<Warning>
  **Violation Consequences**: Accounts engaging in prohibited uses will be suspended or terminated without refund. Severe violations may be reported to authorities.

### 3.3 Content Responsibility

**You are solely responsible for**:

* The legality of images you vectorize
* Copyright and trademark compliance
* Ensuring you have rights to process the images
* Any consequences from using the output SVGs

**We are NOT responsible** for:

* Copyright infringement claims against you
* Legal disputes over image ownership
* Quality of your original images

## 4. Credits and Payment

### 4.1 Credit System

**How credits work**:

* **HD Preview**: 2 credits (optional, before full conversion)
* **Full Conversion**: 10 credits per image
* **Expiration**: Credits expire **6 months** from purchase date
* **Non-Refundable**: Credits cannot be refunded once purchased
* **Non-Transferable**: Cannot transfer credits between Figma accounts

### 4.2 Pricing

Current pricing (subject to change per Section 8):

| Starter | \$4 USD | 100 credits | \$0.40              |
| Pro     | \$8 USD | 400 credits | \$0.20              |

**All prices** are in USD and exclude applicable taxes (VAT, sales tax, etc.).

### 4.3 Payment Processing

* **Processor**: All payments handled by PayPro (PCI-DSS Level 1)
* **Methods Accepted**: Credit/debit cards (Visa, Mastercard, Amex, Discover)
* **Receipts**: Emailed automatically by PayPro after purchase
* **Security**: We never see or store your full card details

### 4.4 Taxes

You are responsible for:

* Applicable sales tax, VAT, or GST
* Reporting purchases to tax authorities (if required)
* Providing valid tax exemption certificates (if applicable)

Prices displayed do NOT include taxes unless stated otherwise.

### 4.5 Refund Policy

**Credits are non-refundable**, except in these cases:

* **Service Failure**: Plugin fails to process conversion after deducting credits
* **Duplicate Charges**: You were charged twice for the same purchase
* **Technical Errors**: Credits deducted but no SVG returned

**To request a refund**:

2. Subject: "Refund Request"
3. Include: Transaction ID, date, issue description
4. Timeline: Within 7 days of the charge

**We will NOT refund**:

* ❌ Unused credits (you changed your mind)
* ❌ Expired credits (you didn't use them in 6 months)
* ❌ Poor results (due to low-quality source images)
* ❌ Credits used successfully (you didn't like the output)

  **Avoid refund issues**: Always use the **2-credit HD Preview** before committing to a 10-credit full conversion!

## 5. Intellectual Property

### 5.1 Your Content Rights

**You retain full ownership** of:

* ✅ Your original bitmap images
* ✅ Output SVG files generated by the Service
* ✅ Designs you create using the SVGs

**You grant us** a limited license to:

* Temporarily store and process your images (during conversion only)
* Send your images to Vectorizer.ai API (necessary for service)
* Delete your images immediately after processing (within 60 seconds)

**We do NOT**:

* ❌ Claim ownership of your images or SVGs
* ❌ Use your images for AI training or marketing
* ❌ Store your images long-term
* ❌ Share your content with third parties (except Vectorizer.ai for processing)

### 5.2 Our Intellectual Property

**We own all rights to**:

* The Vectorized (AI Vectorizer) - Image Tracer plugin code and design
* Our website, documentation, and branding
* Our trade names, trademarks, and service marks
* Our user interface and preset algorithms

**You may NOT**:

* ❌ Copy, modify, or reverse engineer our plugin code
* ❌ Use our name/logo without written permission
* ❌ Create derivative plugins based on our code
* ❌ Remove or alter copyright notices

### 5.3 Third-Party IP

**Vectorizer.ai** owns all rights to their AI vectorization algorithm and API. See [Vectorizer.ai Terms](https://vectorizer.ai/policies/terms) for their IP policy.

## 6. Warranties and Disclaimers

### 6.1 Service "As Is"

The Service is provided **"AS IS"** and **"AS AVAILABLE"** without warranties of any kind, including:

* ❌ No guarantee of **uninterrupted service**
* ❌ No guarantee of **100% accurate vectorization**
* ❌ No guarantee of **specific quality results**
* ❌ No guarantee that the Service will meet your requirements

### 6.2 Quality Disclaimer

**Vectorization quality depends on**:

* Source image quality (resolution, noise, artifacts)
* Your chosen settings (quality, detail, colors)
* Image complexity (simple logos vs. complex photos)
* Vectorizer.ai's AI algorithm limitations

**We do NOT guarantee**:

* ❌ Perfect results for all images
* ❌ Specific file sizes or polygon counts
* ❌ Compatibility with all design tools
* ❌ Results matching your expectations

  **Important**: Always use the **HD Preview** (2 credits) to verify results before spending 10 credits on full conversion.
</Warning>

### 6.3 No Consequential Damages

**We are NOT liable for**:

* Lost profits or business opportunities
* Data loss or corruption
* Missed deadlines due to service issues
* Client disputes over output quality
* Indirect, incidental, or consequential damages

**Maximum Liability**: Our total liability to you for any claim is limited to the **amount you paid us in the 3 months before the claim** (or \$50 USD, whichever is greater).

### 6.4 Your Warranties

By using the Service, you warrant that:

* You have the right to vectorize the images you submit
* Your use complies with all applicable laws
* You will not infringe third-party intellectual property rights
* You are at least 13 years old (or 16 in the EU)

## 7. Indemnification

You agree to **indemnify and hold harmless** Vectorized (AI Vectorizer) - Image Tracer, its owners, employees, and partners from:

* Claims arising from your use of the Service
* Copyright or trademark infringement claims
* Violation of these Terms or applicable laws
* Your breach of third-party rights

**Example**: If you vectorize a copyrighted logo without permission and the owner sues us, you agree to cover our legal costs and damages.

## 8. Changes to Service and Terms

### 8.1 Service Changes

**We reserve the right to**:

* Modify or discontinue features (with 30 days' notice for major changes)
* Change pricing (existing credits unaffected)
* Adjust credit costs per conversion (with 60 days' notice)
* Improve or update the plugin at any time

### 8.2 Price Changes

**For new purchases**:

* We may change credit prices with **60 days' advance notice**
* Changes posted in plugin and on website
* Previous purchases/credits unaffected by price increases

**Your options**:

* Continue using the Service under new prices
* Purchase credits at current prices before increase
* Stop using the Service (unused credits non-refundable)

### 8.3 Terms Updates

**We may update these Terms**:

* For legal compliance (new regulations)
* To clarify existing policies
* To add new features or services

**How we notify you**:

* Updated "Last Updated" date at top of this page
* In-plugin notification for material changes
* Continued use = acceptance of updated Terms

**If you disagree**: Stop using the Service (no refunds for unused credits).

## 9. Termination

### 9.1 Your Right to Terminate

You may stop using the Service at any time by:

* Uninstalling the plugin from Figma

**Upon termination**:

* Your unused credits are forfeited (non-refundable)
* Your user data will be deleted within 30 days
* You may re-install later (credit balance restored if within deletion period)

### 9.2 Our Right to Terminate

**We may suspend or terminate your access** if you:

* Violate these Terms (prohibited uses, abuse)
* Engage in fraudulent activity (chargeback fraud)
* Overload our systems (excessive API calls)
* Infringe third-party rights repeatedly

**Consequences**:

* Immediate suspension (no prior warning for severe violations)
* No refund for unused credits
* Permanent ban for repeat offenders
* Legal action for damages (if applicable)

### 9.3 Effect of Termination

Upon termination by either party:

* You must stop using the Service immediately
* Unused credits are forfeited
* These Terms survive termination (Sections 5, 6, 7, 10)
* You may still contact us for support issues

## 10. Legal and Miscellaneous

### 10.1 Governing Law

**Dispute resolution**:

* Contact us first (email: [zouwenqiang678@gmail.com](mailto:zouwenqiang678@gmail.com)) to resolve any issues
* We aim to resolve all disputes amicably and promptly

### 10.2 Entire Agreement

These Terms, along with our [Privacy Policy](/legal/privacy-policy), constitute the entire agreement between you and Vectorized (AI Vectorizer) - Image Tracer.

**Supersedes**: All prior agreements, communications, or understandings

### 10.3 Severability

If any provision of these Terms is found invalid or unenforceable:

* That provision will be modified to the minimum extent necessary
* All other provisions remain in full effect

### 10.4 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

### 10.5 Assignment

* **You may NOT** transfer these Terms or your account to anyone else
* **We may** assign these Terms to a successor company (acquisition, merger)

### 10.6 Force Majeure

We are not liable for delays or failures due to circumstances beyond our control:

* Natural disasters, wars, pandemics
* Internet outages, cyberattacks
* Third-party service failures (Vectorizer.ai, PayPro, AWS)
* Government actions or regulations
